In the event of a delay in repayment of the Loan, the Lender reserves the right to charge interest for delay in the amount provided for in Article 481 § 21 of the Civil Code, ie in the amount constituting twice the sum of the reference rate of the National Bank of Poland and 5.5 percentage points. The Borrower may be charged with the cost of the Lender’s recovery of the amount due by means of court proceedings and enforcement on the terms set out in the relevant provisions: Code of Civil Procedure, Law on Court Costs in Civil Matters and Law on Court Bailiffs and Enforcement.

In the case of joint fulfillment of the conditions specified in art. 14 par. 1 point 1-3 of the Act of 9 April 2010 on sharing business information and exchange of economic data (consolidated text: Journal of Laws of 2014, item 1015, as amended). The lender has the right to disclose information about the Borrower’s liabilities to Economic Information Bureaus (or Economic Information Bureaus). The transfer of information about the Borrower’s obligations to the Economic Information Bureau is made on the basis of a written agreement on the disclosure of economic information concluded by the Lender with this Economic Information Bureau.

The Borrower’s personal data will be processed for the purpose of considering the loan agreement between the Borrower and the Lender, and also to submit inquiries about the Borrower to the business information bureaus (BIG InfoMonitor, National Economic Information Bureau) and the Credit Information Bureau. In addition, if the Borrower agrees, the data will also be processed for marketing purposes.

The legal basis for the processing of personal data is art. 6 par. 1 lit. a), art. 6 par. 1 lit. b), art. 6 par. 1 lit. c) and art. 6 par. 1 lit. f) RODO, where the legitimate purpose is to process data for archiving purposes. At any time the Borrower has the right to withdraw his consent, this will not affect the lawfulness of the processing, which was made on the basis of consent before its withdrawal. Providing the data is not mandatory, but necessary to submit the application and to proceed with it by the Lender.

The authorized entity competent to settle the dispute arising from the Agreement between the Borrower and the Lender is the Financial Ombudsman. Contact to the Financial Ombudsman and detailed information about the proceedings are available on the website www.rf.gov.pl.

In order to resolve the dispute between the Lender and the Borrower, there is also the possibility of using the ODR internet platform, available at: http://ec.europa.eu/odr, which facilitates out-of-court resolution of disputes between consumers and entrepreneurs via the Internet.
